Mirandizing Terrorists...Please Explain This To Me

"...The Independent chairman and the ranking Republican on the Senate Homeland Security Committee, Joe Lieberman and Susan Collins, demanded that Umar Farouk Abdulmutallab be charged as an enemy combatant rather than in a U.S. criminal court.

The decision to charge him in a criminal court "almost certainly prevented the military and the intelligence community from obtaining information that would have been critical to learning more about how our enemy operates and to preventing future attacks," they said in a letter to Attorney General Eric Holder and Obama's counterterrorism adviser John Brennan...." (source)

Of course as everyone knows (and has most likely yelled at the TV about) is that Crotch-bomber Abdulmutallab is being afforded the right to remain silent and the right to an American tax-payer funded public defender.

Yesterday, Judge Andrew Napalitano and Shepard Smith were both criticizing Lieberman, Collins and any Americans that agreed with them. I believe the Judge said something like (and I'm paraphrasing) ["they agree until they get pulled out of their house and taken down to GITMO"]. What? Judge, the difference is *I* am an AMERICAN CITIZEN. Seriously, does that not matter? Is anyone that enters the country afforded our protections --even if they were trying to blow us up and I missed that history class?

Is this mandated by law or does this administration actually think of terrorism as a criminal act...regardless of what they say? I want to understand.
